This page together with our Privacy Policy, Cookie Policy and Terms of Use tells you information about us and the legal terms and conditions (Terms) on which we sell any of our services such as classes or clubs, listed on our website (our site) to you.
These Terms will apply to any contract between us for the sale of Services to you (Contract). Please read these Terms carefully and make sure that you understand them, before attending any of our classes or clubs as shown on our site. If you refuse to accept these Terms, you will not be able to attend any of our classes or clubs.
You should print a copy of these Terms or save them to your computer for future reference.
We amend these Terms from time to time as set out in clause 4. Every time you wish to order Services, please check these Terms to ensure you understand the terms which will apply at that time. Refer to the bottom of this page for date these terms were updated.
These Terms, and any Contract between us, are only in the English language.
1. Information about us
1.1. We operate the website WhileRobot.com ("our site"). Our site is provided and owned by Develop Maths Ltd, a company registered in England and Wales under the company number 9110783 and with our registered office at Develop Maths Ltd, Kemp House, 152 City Road, London EC1V 2NX. Our VAT number is 261 0322 53.

If you are emailing us or writing to us please include details of the course you wish to attend along with the dates concerned to help us to identify it.
1.2.2. If we have to contact you or give you notice in writing, we will do so by e-mail or by phone as recorded on the booking form.
2. Use of our site
2.1. Your use of our site is governed by our Terms of Website Use. Please take the time to read these, as they include important terms which apply to you.
3. How we use your personal information
3.1. We only use your personal information in accordance with our Privacy Policy. We use cookies on our site, details of which can be found in our Cookie Policy. Please take the time to read our Privacy Policy and Cookie Policy, as they include important terms which apply to you.
4. Our right to vary these Terms
4.1. We amend these Terms from time to time. Please look at the bottom of this page to see when these Terms were last updated and which Terms were changed. Every time you order Services from us, the Terms in force at the time of your order will apply to the Contract between you and us. We may revise these Terms as they apply to your order from time to time to reflect changes in relevant laws and regulatory requirements.
4.2. If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes.
5. Booking and Fees
5.1. You shall fully complete the Booking Form on the first taster lesson, if you choose to attend subsequent lessons.
5.2. After the first free taster lesson. All subsequent lessons are to be paid in full by cheque. By paying for the fee you and the Student agree to be bound by these conditions. Bookings are subject entirely to these Terms and Conditions together with our website terms of use.
5.3. Bookings are accepted at the discretion of Develop Maths and are not transferable.
5.4. Payment for all courses must be paid in full for your place to be secured unless otherwise stated.
6. Your conduct
6.1. You must comply with all rules and regulations issued by Develop Maths from time to time.
6.2. If Develop Maths considers that the Student has behaved in an unacceptable manner, Develop Maths will be entitled to require the Student to cease to attend the rest of the course.
6.3. Any failure by the Student to adhere to the Rules may result in his/her participation at the Class being terminated forthwith without refund.
6.4. Without prejudice to paragraph 6.3 above, Develop Maths reserves the right to withdraw the Student from any activity at any time on the grounds of safety or unsuitability.
7. Cancellation
7.1. All bookings are subject to the right to cancel in writing (by e-mail to us) within fourteen (14) calendar days of the first free taster lesson according to the Consumer Contracts Regulations 2013. Outside of this fourteen (14) day period refer to paragraph 7.2 below.
7.2. In the event of cancellation by you, a credit note will only be issued if such cancellation is notified in writing to Develop Maths at least one month before the commencement of the Class. An administration charge of £25 per week per child will be deducted from the credit. No refunds will be issued and bookings cancelled in the last month prior to the date of the class will not be reimbursed.
7.3. Develop Maths will be entitled to change the timing and/or content of any course and to substitute any teacher at any time.
7.4. If Develop Maths has to cancel a class or course for any reason, a credit note for the full value of the booking fee paid will be issued to the person who booked or alternative provisions to stage the class or course at another time will be arranged and confirmed to all. If you are unable to attend at the alternatively arranged time and confirm this to Develop Maths you will be issued with a credit note to the full value of the booking fee paid.
7.5. Fees are non-returnable for students arriving late, leaving early (whether on account of illness or any other cause)
8. Liability
8.1. Subject to 8.2 Develop Maths shall not be liable to you or the Student by reason of any representation or any implied warranty, condition or other term or any duty at common law or under the express terms of this Agreement for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by our negligent or the negligence of our staff, or agents or otherwise) which arise out of or in connection with the provision of the Service or their use by you or the Student, and our entire liability under or in connection with this Agreement shall not exceed the amount of our Fees paid by you for the provision of the Service purchased during the six-month period proceeding the applicable claim.
8.2. We do not in any way exclude or limit our liability for:
8.2.1. death or personal injury caused by our negligence;
8.2.2. fraud or fraudulent misrepresentation;
8.3. Where Develop Maths provides, in connection with the provision of the Services, any goods or equipment or services supplied by a third party, Develop Maths does not give any warranty, guarantee or other terms as to their quality, fitness for purpose, performance or otherwise.
8.4. Develop Maths shall have no liability to the Student for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by you which are incomplete, incorrect, inaccurate or illegible, or arising from the Student's late arrival or non-arrival, or any other fault of you or the Student.
8.5. Develop Maths shall not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of Develop Maths's obligations in relation to the Services, if the delay or failure was due to any cause beyond Develop Maths reasonable control.
8.6. Develop Maths reserve the right to alter programmes, activities, itineraries, excursions, age brackets, premises and personnel as it thinks fit and without notice.
8.7. Develop Maths will not be bound by any statement unless it is in writing and authorised by a Director of Develop Maths.
8.8. You agree to be wholly liable for any and all actions and/or omissions of the Student. Without prejudice to the generality of the foregoing, you shall be liable for any liability, financial or otherwise, or injury or damage to property caused by the Student whilst attending the class, and shall fully indemnify Develop Maths, their agents, contractors and/or employees for any loss, damage, costs or expenses resulting from such liability, injury or damage.
9. Medical and Behavioural
9.1. Any medical condition or behavioural problems of the Student known to you must be fully disclosed at the time of booking in writing to Develop Maths. Develop Maths reserve the right not to accept your Booking on the grounds that any such medical or behavioural problems are not conducive to the Student's or other students' participation in the Class.
9.2. If the Student becomes ill or comes into contact with any contagious or infectious disease during the 21 days prior to the commencement of the Camp or Club, you must immediately notify Develop Maths Ltd by email and provide a medical certificate from the Student's doctor giving approval for the Student to participate in the Class.
9.3. It is your and the Student's responsibility to help Develop Maths prevent the spread of infectious diseases.
9.4. It is your responsibility to tell Develop Maths Ltd prior to camp of any issue or condition that may affect their stay at camp. These include but are not limited to ADHD, SEN, medical, languages, disabilities, diet, medical, behavioural/social issues, child's history.
9.5. Develop Maths Ltd reserves the right to remove any student whose attendance, work or behaviour is, in their reasonable opinion, unsatisfactory. Under such circumstances, Develop Maths Ltd will be under no obligation to return any fees. Children who disrupt the learning environment for other participants, who destroy property or projects, and who otherwise compromise the health, safety and/or learning environment will be removed.
10. Publicity
10.1. Develop Maths Ltd may from time to time take photographs/film of any Develop Maths Class, the use of this data is solely for the purpose of promoting and publicising Develop Maths Activities through literature, website, social media, press and TV.
10.2. Parents/guardians that do not wish for their child to be photographed/filmed must make Develop Maths aware of this at the time of booking or in writing before the course starts (where possible Develop Maths will inform parents/guardians at the start of a class).
10.3. You acknowledge that Develop Maths may use for publicity purposes and without prior notification any written statement made by you or the Student.
10.4. Develop Maths will hold all personal data in accordance with its Privacy Policy.
11. Child Protection/Safeguarding
11.1. Develop Maths Ltd will contact Local Safeguarding Children's board if we suspect abuse or in an event of a disclosure.
12. Force Majeure
12.1. We shall not be liable for any delay in performing or failure to perform any obligation (including to action any alteration or cancellation) due to any case beyond our reasonable control including lock-outs, strikes, shortages of personnel, labour disputes, war, riot, act of God, civil commotion, terrorism, malicious damage, threats to safety, compliance with any law or governmental order, rule, regulation or direction, accident, environmental contamination, pandemic outbreak of disease, breakdown of plant or machinery, fire, flood, storm, difficulty or increased expense in obtaining workmen, materials, goods or raw materials in connection with the performance of this agreement.
13. Information
13.1. We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you in writing or by posting on this website if this happens.
13.2. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
13.3. This Contract is between you and us. No other person shall have any rights to enforce any of its terms.
13.4. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
13.5. The information on this site is updated regularly. However, we hereby exclude any warranties (whether expressed or implied) as to the quality, accuracy, efficacy, completeness, performance, and fitness for a particular purpose of the site.
13.6. These Terms and Conditions along with Terms of Use form the entire agreement between you and Develop Maths.
13.7. If any term within these Terms and Conditions is found to be unenforceable by a competent Court then such term shall be struck out but the remaining terms within these Terms and Conditions shall continue in force to the full extent permitted by law.
13.8. These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the Courts of England.
